This case was tried before Mr. Moody to obtain the sum £15, for instruction in a certain kind of drawing. The plaintiff was William Binns, a teacher of mechanical drawing. The defendant's name was also William Binns, nephew to plaintiff. Defendant had lodged with plaintiff for two years, during which the latter had given instruction in drawing, upon which he founded his demand. Defendant for three years previous to residing with plaintiff, and also during the term of lodging with him, had rendered services in English composition, correction of reports, &c. It was stated in defence, that plaintiff was publishing a work on drawing, in which defendant had assisted him as to the composition;one or two instances were mentioned by defendant of plaintiff's inelegancies or errors in composition, such as concluding sentences with significant words as of, to, for ; and also using; a nominative singular with a verb plural. It was shown that the plaintiff had sent in two distinct accounts, one extending over two years, the other over 18 months, each claiming the same amount. Defendant had proposed to settle the matter by arbitration, and had offered £8 in addition to his literary services, in order amicably to adjust the matter—Verdict :-The defendant to pay £8 and costs.
